NOTICE OF SALE TO BIDDERS Notice is hereby given that the Town of Spiceland will receive bids for the property located at 114 N 6th Street, Spiceland, Indiana, beginning on the second notice of the date of this publication and ending at the meeting on June 5, 2019 at 6:00 p.m. The property is further described as follows: Lot 15 in Mordecai White's Addition to the town of Spiceland, Indiana. More commonly known: 114 N 6th Street, Spiceland, IN 47385. Parcel No. 33-17-17-240-277.000-026/33026-04111-00 Subject to all legal covenants and restrictions of record. Bids must be in writing and will be unsealed and considered ongoing and will be received at Town Hall, 130 East Main Street, Spiceland, Indiana 46385, during business hours, which are Monday through Friday from 8:00 a.m. to 4:00 p.m. Bids will be accepted or rejected at the regular Town Hall meeting on June 5, 2019, at 6:00 p.m. The offering price is $2,500.00 plus Bidder is responsible for appraisal fees, broker opinions, title work, recording fees, advertising costs, taxes, and all closing costs. Bidding may begin ten days after the last publication. Bids are open and bidders may review bids and raise bids in writing to the Clerk-Treasurer or by voice bid at the meeting. A proposed sale agreement is on file with the Clerk-Treasurer's office. Bidders are purchasing the real estate as-is. Bidders also understand the Town will only issue a quit claim deed to convey title to the real estate. Ten percent (10%) of the bid price is required at the meeting with the balance due at closing. The property may not be sold to a person who is ineligible under Indiana code 36-1-11-16. A bid submitted by a trust must identify each beneficiary of the trust and settlor empowered to revoke or modify the trust. The seller reserves the right to reject any and all bids. AN ORDINANCE ESTABLISHING RATES AND CHARGES TO BE COLLECTED BY THE TOWN OF STRAUGHN, INDIANA, FROM THE CUSTOMERS SERVED BY THE MUNICIPAL ELECTRIC UTILITY OF SAID TOWN, AND OTHER MATTERS CONNECTED HEREWITH. WHEREAS, the Town of Straughn, Indiana (“Straughn”) owns and operates a municipal electric for the purpose of providing and distributing electrical energy in said Town and surrounding areas; and, WHEREAS, Straughn has caused a financial and cost-of-service study of the Town's municipal electric utility (“Rate Study”) to be made by the IMPA Service Corp., Carmel Indiana; and WHEREAS, the Rate Study indicates that the current electric rates and charges are not adequate to meet the reasonable requirements of the utility and that the electric rates and charges should be altered pursuant to the finding of said studies; and WHEREAS, the Straughn Town Council has heretofore found that the existing rates and charges for the use of and services rendered by the municipal electric utility of said Town are not adequate and are not based on the actual cost of providing said services to the carious customer classes and that as a result thereof , it is necessary that said rates be altered in order to enable the Town to properly operate this municipal electric utility, provide for depreciation thereof, finance necessary extensions, betterments, and improvements to the system, and that the existing rates and charges should be altered. WHEREAS, the Straughn Town Council has now determined, based upon the Rate Study and the above consideration that the proposed rates and charges as set for ton Exhibits “A” and “B” attached hereto are reasonable and just rates to provide for the continued operation of said electric utility; and WHEREAS, the Straughn Town Council finds that the rates and charges set forth herein should be adopted, all as herein provided herein. NOW, THEREFORE, BE IT HEREBY ORDAINED by the Town Council of the Town of Straughn, Indiana, as follows: SECTION 1: That the proposed rates and charges set forth in Exhibit “A” attached hereto and made a part hereof are hereby adopted and established for the use of the service rendered by the Straughn Municipal Electric Utility. SECTION 2: For the purpose of billing and collecting the charges for electric use, the meters shall be read monthly and the use shall be billed monthly. SECTION 3: All ordinance and parts of ordinances in conflict herewith are hereby repealed. SECTION 4: That he electric utility rates and charges adopted hereby shall become effective for all bills payable in full force and effect after its passage. LEGAL NOTICE STATE OF INDIANA INDIANA UTILITY REGULATORY COMMISSION CAUSE NO. 45325 PETITION OF INDIANA MICHIGAN POWER COMPANY, AN INDIANA CORPORATION, FOR AUTHORITY TO INCREASE ITS RATES AND CHARGES FOR ELECTRIC UTILITY SERVICE THROUGH A PHASE IN RATE ADJUSTMENT; AND FOR APPROVAL OF RELATED RELIEF INCLUDING: (1) REVISED DEPRECIATION RATES; (2) ACCOUNTING RELIEF; (3) INCLUSION IN RATE BASE OF QUALIFIED POLLUTION CONTROL PROPERTY AND CLEAN ENERGY PROJECT; (4) ENHANCEMENTS TO THE DRY SORBENT INJECTION SYSTEM; (5) ADVANCED METERING INFRASTRUCTURE; (6) RATE ADJUSTMENT MECHANISM PROPOSALS; AND (7) NEW SCHEDULES OF RATES, RULES AND REGULATIONS. Please be notified that on May 14, 2019, Indiana Michigan Power Company filed a Petition with the Indiana Utility Regulatory Commission (“Commission”) in Cause No. 45325 for (1) authority to increase its rates and charges for electric utility service through a phase in rate adjustment; and for approval of related relief including: (1) revised depreciation rates; (2) accounting relief; (3) inclusion in rate base of qualified pollution control property and clean energy project; (4) enhancements to the dry sorbent injection system; (5) advanced metering infrastructure; (6) rate adjustment mechanism proposals; and (7) new schedules of rates, rules and regulations. A copy of the Verified Petition and other submissions in this proceeding are on file with the Indiana Utility Regulatory Commission, 101 W.
